Employees covered by Taiwan’s Labor Standards Act get 16 national holiday days a year. In 2027, nine fall on weekdays and seven fall on a Saturday or Sunday, so a Monday-to-Friday team is also owed seven substitute days off.

The government’s 2027 office calendar, published on 21 May 2026, has no bridge days and no Saturday make-up workdays. Its only extra days off are substitute days for weekend holidays. Private employers do not have to use those exact dates: the law requires a substitute day, and the date is agreed with the employee.

An employee who agrees to work on a holiday must be paid double: the normal wage for the day plus one extra day’s wage.

Employees with Indigenous status may also take three days off during the ceremonial period of their own, their spouse’s or their parents’ Indigenous group, on dates announced by the Council of Indigenous Peoples.

Which days private employers must give

The Labor Standards Act requires employers to give, with full pay, the commemorative days and festivals that the law designates as days off. Since May 2025 that list comes from a new law on commemorative days and festivals. It gives a day off for six commemorative days (Founding Day, Peace Memorial Day, Confucius’ Birthday, National Day, Retrocession Day and Constitution Day); five days for Lunar New Year, from the day before New Year’s Eve to the third day of the new year; and one day each for Children’s Day, Tomb-Sweeping Day, Labor Day, Dragon Boat Festival, Teachers’ Day and Mid-Autumn Festival. Teachers’ Day and Confucius’ Birthday share a date, which is why the total is 16. Other festivals, such as the Lantern Festival, are not days off.

The Ministry of Labor confirms that part-time staff and student workers have the same holidays. Foreign employees covered by the Act follow the same rules.

When a holiday falls on a rest day or regular leave day

Every employee has a regular leave day and a rest day each week. If a national holiday falls on either, the employer must give a substitute day off on another workday. The date is agreed between employer and employee, and the substitute day has the same status as a national holiday.

What counts is the employee’s own schedule, not the calendar weekend. A shop employee whose days off are Tuesday and Wednesday is owed a substitute day for Dragon Boat Festival (Wednesday 9 June 2027), but simply has Saturday 1 May off for Labor Day.

Government bridge days and make-up workdays

The government calendar is for government offices. In years when it creates a long weekend by moving a workday to a Saturday, private employers are not bound by it. According to the Ministry of Labor, an employer that wants to follow such an adjustment must use the Act’s flexible working-hours rules, which need consent from the union or, without a union, the labor-management meeting. Employers with three or fewer employees may agree directly with their staff. In 2027 the issue does not arise, because the calendar has no such adjustments.

Working on a holiday: double pay

An employer needs the employee’s consent before they work on a national holiday, and must then pay double: the day’s wage as usual plus one extra day’s wage. A monthly salary already covers the holiday itself, so the employer adds one day’s wage, calculated as monthly salary ÷ 30.

Swapping a holiday for another workday

An employer may swap a national holiday for a normal workday. The Ministry of Labor requires each employee’s personal consent, and the agreement must state exactly which workday replaces which holiday. The holiday then becomes a workday and the agreed day must be given off. Swapping cannot reduce the total number of holidays.

FAQ

Do private-sector employees get Teachers' Day, Retrocession Day and Constitution Day off in 2027?

Yes. All three are among the 16 national holiday days: Tuesday 28 September, Monday 25 October and Saturday 25 December 2027. Because Constitution Day falls on a Saturday, a Monday-to-Friday employee is owed a substitute day; the government uses Friday 24 December.

How long is the 2027 Lunar New Year holiday for private employees?

Five holiday days, Thursday 4 February to Monday 8 February 2027. Two fall on the weekend, so a Monday-to-Friday employee is also owed two substitute days. Using the government dates (Tuesday 9 and Wednesday 10 February) gives a seven-day break.

Labor Day 2027 is a Saturday. Do employees have to get Friday 30 April off?

They must get a substitute day, but the law does not fix the date. Friday 30 April is the government’s choice; any other workday agreed with the employee also works.

Can an employer give a day off instead of double pay for holiday work?

Only if the employee agrees after working the holiday. Without that agreement, the employee is owed one extra day’s wage on top of normal pay.
